HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL REVISION CASE No.40 OF 2018 ORDER:

Aggrieved by the order, dated 29.06.2017, in I.A.No.368 of 2016 in FCOP.No.1647 of 2015 on the file of the Judge, Additional Family Court, Visakhapatnam, whereby and whereunder, interim maintenance at the rate of Rs.5,000/- per month was awarded to the wife, the present Criminal Revision Case is filed by the husband. Heard Sri V. Brahmaiah Chowdary, learned counsel for the revision petitioner.

The main grievance of the revision petitioner - husband is that, though, he is just a B.Tech graduate, by the order under challenge, the learned Judge, Additional Family Court, has awarded Rs.5,000/- per month towards interim maintenance, and, therefore, seeks to set aside the order.

The order under revision would reflect that the husband is doing a decent job and, when kept in view, his income and the soaring prices including the price escalation and the present day price index number, the amount of Rs.5,000/- per month awarded towards interim maintenance cannot be construed as excessive. There is no merit in the present revision case.

Hence, the present Criminal Revision Case is dismissed. It is made clear that the award of interim maintenance at the rate of Rs.5,000/- per month shall not come in the way of awarding just and

reasonable maintenance amount in the main Maintenance Case depending on the evidence that would be let in. As a sequel, the miscellaneous petitions if any pending shall stand closed.
