ORDER

This writ petition is filed seeking to declare the action of the respondent in withholding the pension in P.P.O.No.SGC.100254 as arbitrary and illegal.

Heard Sri G. Praveen Kumar, learned counsel, as amicus curie and the learned Government Pleader for Finance. 3.

Sri G. Praveen Kumar, learned counsel, as amicus curie, contended that the petitioner is challenging the orders passed by the civil Court in withholding the pension amount. 4.

In pursuance of the orders passed by the competent civil Court in E.P.No.361 of 2011 in O.S.No.715 of 2000 on 26.06.2001 an amount of Rs.30,779/- was withheld from the retrial benefits of the petitioner. When the competent civil Court has passed the said order, this Court cannot direct the respondent to release the due pension to the petitioner and there are no merits in this writ petition. 5.

Hence, the Writ Petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
