HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO ARBITRATION APPLICATION No.8 of 2019 ORDER:

This application is filed under Section 11 (5) of the Arbitration and Conciliation Act, 1996 by the applicant for appointment of an Arbitrator to decide the disputes between the applicant and the respondents arising out of the registered Development Agreement dated 01.07.2013 and registered Supplemental Agreement dated 27.11.2017.

2. The Arbitration Clause between the parties is as under: "26. This agreement and all its related conditions will be governed by the Laws of India and State of Andhra Pradesh any dispute arising out of this agreement shall be referred to an mutually agreed arbitrator and place of Arbitration will be at Hyderabad only. Any further dispute in this regard to the exclusive jurisdiction of courts in Hyderabad and District of Ranga Reddy only."

3. Though the counsel for the respondents had filed a counter affidavit opposing the appointment of an Arbitrator, he stated that his clients have no objection for appointment of an Arbitrator by this Court to adjudicate the disputes between the parties arising out of and in relation to the above agreements.

4. Therefore, Hon'ble Justice G.V.Seethapathy, former Judge of this Court residing at H.No.5-8-30/34, Govardhanpuri Gardens, Yapral, Secunderabad-87, is appointed as the sole Arbitrator to decide the disputes between the parties arising out of the above referred agreements and in relation thereto.
