Heard learned counsel on either side.
This writ petition is filed seeking to declare the suspension order-cum-show cause notice dated 12.01.2015 issued by the 4th respondent whereunder the petitioner was suspended temporarily from the post of Field Assistant working in Silagam Singivalasa Village, Srikakulam Mandal & District, as arbitrary and illegal.
The petitioner was appointed as Field Assistant in Silagam Singivalasa Village, Srikakulam Mandal & District, under Mahatma Gandhi National Rural Employment Guarantee Scheme by 5th respondent on 15.2.2010. While so, the 4th respondent vide order dated 12.1.2015 suspended the petitioner temporarily, alleging certain irregularities.
The grievance of the petitioner is that without issuing any prior notice, the impugned suspension order was passed.
The substantial charge, based on which the
petitioner was suspended, was that she failed to affix the pay slip receipts to the job cards properly. In the considered opinion of this Court, the charges are trivial in nature and they do not warrant suspension.
Under these circumstances, the Writ Petition is disposed of directing the respondents to complete the enquiry as expeditiously as possible. However, the order of suspension dated 12.1.2015 shall stand revoked and the petitioner is ordered to be reinstated into service. No costs.
As a sequel, Miscellaneous Applications, if any, shall stand closed.
