Rangababu , B. Gurumurthy v. The State Of A.P Rep By Its P.P
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.106 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A24, in Crime No.443 of 2017 on the file of Tirupathi East Police Station, Tirupathi, Chittoor District. The offences alleged are under Sections 146, 302 and 506 r/w 149 of IPC.
2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
The counsel for the petitioner submits that other accused in this case were granted bail by this court. Since this petition is for anticipatory bail, the nature of allegations have to be considered and the nature of the allegations do not deserve the petitioner for anticipatory bail, as it is the case of the prosecution that this petitioner, along with others has attacked the defacto complainant.
4.
Hence, in view of the above allegations, this court opines that this is not a fit case for granting anticipatory bail. 5.
Accordingly, the Criminal Petition is dismissed.
However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed,
expeditiously, preferably on the same day, subject to the pressure of other work.
6.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 22.01.2018 SS
