THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9332 of 2009 ORDER:

Petitioner in this writ petition challenges the action of respondent Nos.4 and 5 in proceeding to establish a Restaurant in premises bearing H.No.8-2-293/82/A/1285/B (Plot No.1285/B), Road No.64, Jubilee Hills, Hyderabad, on the ground that it is a commercial activity and is contrary to the Urban Development Authority Zoning Regulations, 1981.

On 30.04.2009, while admitting the writ petition, this Court passed an order of status quo.

In his counter-affidavit, respondent No.3 has not denied the averments of the petitioner. Even as on date, no counter-affidavit is filed by the official respondents specifically denying the allegations mentioned in the writ affidavit.

Today, Sri L.Venkateswara Rao, learned Standing Counsel for the Corporation placed before this Court, a report, dated 02.07.2018, wherein it is stated that in the subject premises, no commercial activity is being carried out and the same is being used for residential purpose.

In the light of the above, the writ petition is disposed of. It is made clear that no permission as such shall be granted for

carrying on any commercial activity in the subject premises contrary to the above said Regulations.
