THE HON'BLE SRI JUSTICE C.V. BHASKAR REDDY Contempt Case No.49 of 2018 ORDER:

This Contempt Case is filed by the petitioner against the respondents, alleging wilful and deliberate violation of the order passed by a learned Single Judge of this Court in Writ Petition No.10489 of 2017, dated 23.03.2017. 2.

Vide above order, the learned Single Judge disposed of the writ petition by directing respondent Nos.2 and 3 therein to consider the representation / complaint dated 30.03.2017 submitted by the petitioner and take action thereon in accordance with law, if there are any violations committed by the 4th respondent therein, within a period of four (04) weeks from the date of receipt of copy of the order.

On 16.02.2018, notice was ordered to the 1st respondent herein. Thereafter, the 1st respondent filed counter-affidavit.

In the counter-affidavit, the 1st respondent contended that after receipt of copy of the order passed by the learned Single Judge (referred supra), the 1st respondent had removed the encroached portion on the road and cleared all the debris which was blocked by the fort yard in public Municipal Road No.6, Tirumala Hills, and the same was intimated to the petitioner and also to the District Collector on 07.06.2017, as such, the order passed by this Court had been complied with and there is no wilful and deliberate violation on the part of the 1st respondent in implementation of the same; even after filing the present Contempt Case, the respondents have removed the illegal encroachments and cleared the road thus complying with the order passed by the learned Single Judge; and therefore, prayed this Court that there are no merits in the Contempt Case and hence, the same may be closed. 5.

In view of above submissions, this Court is of the considered view that since the respondents have complied with the order passed by the learned Single Judge, no

further orders are necessary to be passed in the present Contempt Case.

Accordingly, the Contempt Case is closed. No costs. 7.
