THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY Writ Petition No.681 of 2016 Dated 07th January, 2016 Between:

Dr.V.Chandra Sekhar Reddy

...Petitioner

And The State of Andhra Pradesh, Panchayat Raj & Rural Development, Secretariat, Hyderabad, rep.by its Principal Secretary and others

...Respondents

Counsel for the petitioner: Mrs.B.Neeraja Sudhakar Reddy Counsel for respondent Nos.1 to 3: AGP for Panchayat Raj Counsel for respondent No.4: AGP for Revenue The Court made the following:

ORDER:

The petitioner's fish patta over Pedda Rayala Cheruvu @ Rayala Cheruvu of Kolathur Village, Punganur Mandal, Chiittoor District is the subject matter of R.P.No.853/J1/1987-2 before respondent No.1. The grievance of the petitioner in this writ petition is that before the rights of the petitioner are finally adjudicated, respondent No.5 has sent proposals to respondent No.3 for fixing upset price for holding auction of fishery wealth in the tank.

After hearing Smt.B.Neeraja Sudhakar Reddy, I am of the opinion that as the petitioner's revision is pending before respondent No.1, it is appropriate that he may move the said respondent for appropriate interim relief.

Accordingly, without expressing any opinion on the merits of the case, the petitioner is permitted to make an application before respondent No.1 for interim order. Within two weeks of making such application, respondent No.1 shall pass an appropriate order and communicate the same to the petitioner.

Subject to the above direction, the writ petition is disposed of. As a sequel to disposal of the writ petition, WP.M.P.No.842 of 2016 shall stand disposed of as infructuous.
