THE HON'BLE SRI JUSTI CE S.V.BHATT WRI T PETI TI ON NO.343 OF 2018 ORDER:

Heard Mr. P.Vikram, Counsel for petitioner and the learned Assistant Government Pleader (Home) for respondents 1 to 3. On 30.12.2017, the petitioner applied to 3rd respondent for permission to take out religious procession of deities on elephant within the local area of Vanasthalipuram on 22.1.2018. The petitioner, though asserts a right to take out procession, but the petitioner for the present, confines the prayer to the limited extent of inaction in considering and disposing of representation dated 30.12.2017. The Assistant Government Pleader, on instructions, submits that the matter is under active consideration and order shall be passed expeditiously. As he is instructed to take time, he requests the Writ Petition to be listed on 18.1.2018.

Mr. Vikram, Counsel for the petitioner, relies on the order dated 30.1.2017 in Writ Petition No.3109 of 2017 and makes twin statements that firstly the request, if not considered within time or a belated response is given, the petitioner will be put to inconvenience and this Court, while disposing of the said Writ Petition did not appreciate delayed consideration of request made by the petitioner. The contentions are merely noted as the prayer is against inaction. I am satisfied that the Writ Petition can be disposed of by this order.

The Writ Petition is disposed of directing the 3rd respondent to examine the request made through representation dated 30.12.2017 and pass orders within three days from today.

The Assistant Government Pleader is directed to inform the order passed by this Court.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
