Heard learned counsel for petitioner and learned Government pleader for Home for respondents 1, 5 to 7. 2.

This writ petition is filed alleging that even though complaint was filed on 15.05.2017 alleging committing of cognizable offence, crime was not registered. Having waited for considerable time, petitioner instituted this writ petition. 3.

On 05.02.2019 the Station House Officer, Asif Nagar Police Station, issued notice to the petitioner informing him that during the course of enquiry the allegations made by the petitioner are found to be false that his wife already filed complaint in Women Police Station, Kadapa vide Crime No.26 of 2017 and also filed maintenance case pending in the Court of I-Judge Family Court, Kadapa vide M.C.No.542 of 2017. As the issue is purely family disputes the crime is closed. 4.

Since the crime is already closed, it is open to the petitioner to work out his remedies, if not satisfied with the reasons assigned in the notice dated 05.02.2019. However, this Court deem it necessary to observe that as the crime was reported on 15.05.2017, police could not have kept quiet for such a long time and give reply only when a writ petition is filed. It is expected that the officer shall be careful in future whenever cognizable offences are reported.
