HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.13499 of 2017 ORDER:
The petitioner challenges Endorsements dated 31.10.2016 of 4th respondent substantially rejec ting the request of petitioner for issuing pattadar pass book and title deed under the ROR Act. The Assistant Government Pleader (Revenue) contends that the impugned endorsement is appealable before the 3rd respondent, for the 4th respondent declined to enter the name of petitioner in 1-B Register or issue pattadar pass book/ title deed. Mr.Krishna Rao to show to the Court that the petitioner has already invoked the appellate jurisdiction of the Revenue Divisional Officer refers to a representation said to have been made on 24.12.2016 before the Revenue Divisional Officer. The objec tion of the Assistant Government Pleader on the representation dated 24.12.2016 is that it is not in the form of appeal under the ROR Act. If the appeal is filed, the 3rd respondent is under obligation to consider and dispose of the same in accordance with law.
This Court is convinced with the objection raised by the Assistant Government Pleader.
The Court is not prepared to examine the merits of the matter. The petitioner is given liberty to file appeal against
endorsement dated 31.10.2016 by enc losing a copy of this order within four weeks from the date of receipt of a copy of this order. As and when appeal is filed, as permitted by this order, the 3rd respondent examines the original record and passes orders, as are deemed fit, expeditiously.
The writ petition is disposed of accordingly. No order as to costs.
