HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.662 OF 2018 O R D E R :

The case of the petitioner is that he is doing business in purchase, sale and milling of paddy, rice and broken rice; that the respondent authorities allotted 17,900 quintals of paddy for milling and that the petitioner has to supply the resulted rice quantity of 11.993 quintals. The petitioner has supplied a quantity of 4,724 quintals of custom milled rice and still he has to supply the remaining 7,268 quintals of rice after deducting the milled paddy. While so, on 23.12.2017 the 3rd respondent along with other officials inspected and seized 281.50 quintals of rice alleging that the petitioner is purchasing the rice from the persons who brought it belongs to Public Distribution System and supplying the same under Custom Milling Rice Scheme to the government.

Thereafter, when the petitioner approached the 4th respondent to receive the custom milling rice, the 4th respondent refused to receive the same stating that the 2nd respondent instructed him not to receive the rice from the petitioner's rice mill. The petitioner also submitted representation dated 29.12.2017 before the 2nd respondent. Aggrieved by the action of the 4th respondent, the petitioner filed present writ petition seeking direction to the 2nd respondent to instruct the 4th respondent to receive the milled rice from the petitioner.

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies.

Since the grievance of the petitioner is pending before the 2nd respondent by way of representation dated 29.12.2017, the 2nd respondent is directed to consider the same and take action, within a period of two weeks from the date of receipt of a copy of this order. No order as to costs.
