HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 1053 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This writ appeal challenges interim order, dated 14.11.2015, passed in W.P.No.35931 of 2015. The challenge is mainly on the ground that an agreement, dated 15.09.2015, executed between the appellants and the respondent was not placed before learned Single Judge when the order was passed. It is submitted that if the agreement was brought to the notice of learned Single Judge, perhaps learned Single Judge would not have passed the impugned order. Learned counsel for the respondent disputes the statement made on behalf of the appellants.

In view thereof, learned Government Pleader for Women Development and Child Welfare for the appellants seeks permission to withdraw this appeal with liberty to file application for vacating interim order or seeking review of the order impugned in the present appeal. Writ appeal is disposed of as withdrawn with liberty as prayed. Consequently, miscellaneous petitions, if any, also stand disposed of.
