THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.4079 Of 2017 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India is filed challenging the docket order dated 11.07.2017 passed in O.S.No.56 of 2010 on the file of the Court of the Junior Civil Judge, Nandalur.

Heard the learned counsel for the petitioner and the learned counsel for the respondent.

Today this court allowed Civil Revision Petition No.4037 of 2017 setting aside the order dated 22.12.2016 passed in I.A.No.153 of 2016 in O.S.No.56 of 2010 on the file of the Court of the Junior Civil Judge, Nandalur. The parties to this Civil Revision Petition and in Civil Revision Petition No.4037 of 2017 are one and the same. Hence, in view of the orders passed in Civil Revision Petition No.4037 of 2017, the impugned docket order passed by the trial court is not sustainable either on facts or in law. Hence the same is liable to be set aside.

In the result, this Civil Revision Petition is allowed, setting the docket order dated 11.07.2017 passed in O.S.No.56 of 2010 on the file of the Court of the Junior Civil Judge, Nandalur. No order as to costs. As a sequel, miscellaneous petition, if any, pending in this Civil Revision Petition shall stand closed.
