B. Amarender Reddy v. The State Of Telangana
HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.552 OF 2019 O R D E R:
Petitioners are aggrieved by the order dated 06.11.2018 passed by the Revenue Divisional Officer, Kalwakurthy Division, in Appeal No.B/615/2018.
Ms.Ayesha Saba, learned counsel for the petitioners, would fairly concede that the impugned appellate order is amenable to revisionary jurisdiction under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. The scope of the statutory revision would be far wider than the enquiry that can be undertaken by this Court in a Writ Petition filed under Article 226 of the Constitution. In the light of the effective alternative remedy provided to the petitioners, this Court is not inclined to entertain this Writ Petition and adjudicate the issues raised herein on merits.
The Writ Petition is accordingly dismissed leaving it open to the petitioners to invoke the statutory remedy available to them in accordance with law.
Pending Miscellaneous Petitions, if any, shall stand dismissed in the light of this final order. No order as to costs. __________________________ JUSTICE SANJAY KUMAR 21st January, 2019 Kvsn
