HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.37784 OF 2015

ORDER

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the respondents in selecting the 4th respondent for the post of Anganwadi worker in respect of Lakkasagaram Village, Krishnagiri Mandal, Kurnool District, as arbitrary, illegal and consequently to direct the respondents to appoint the petitioner as Anganwadi Worker.

Heard Sri K.Sita Ram, learned counsel appearing for the petitioner and learned Government Pleader for Women Development and Child Welfare.

It is the case of the petitioner that she is a native of Lakkasagaram Village. Pursuant to the notification issued by the official respondents, for filling up the posts of Anganwadi workers, she made an application on 7.8.2015. She is fully eligible and entitled to be appointed as Anganwadi Worker. Though the 4th respondent is a native of neighbouring village, she was selected and appointed. As per the guidelines, one of the conditions for appointing the Anganwadi Worker is, the candidate should be from the same village. Challenging the

appointment of the 4th respondent, the present writ petition is filed.

Learned Government Pleader appearing for respondents 1 to 3 contends that the 4th respondent is a native of Pandirlapalli Village, which is forming part of panchayat of Lakkasagaram Village and hence, her case was considered. Having regard to the facts and circumstances of the case, this Court is of the considered view that the respondents have not committed any irregularity in selecting the 4th respondent and appointing her as Anganwadi Worker. Accordingly, the Writ Petition is dismissed as devoid of merits. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
