THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.185 OF 2016 ORDER:

The grievance of the petitioner in this case was that despite registering Crime No.214 of 2015 on the file of Parkal Police Station, Warangal District, the police authorities were not taking steps therein and in the meanwhile, the unofficial respondents were acting in violation of the order dated 04.01.2002 passed by the learned Junior Civil Judge, Parkal, in E.P.No.10 of 2000.

Written instructions dated 21.01.2016 were furnished by the Sub-Inspector of Police, Parkal Police Station, Warangal District, to the office of the learned Government Pleader for Home, wherein he stated that pursuant to the petitioner's complaint dated 21.07.2015, Crime No.214 of 2015 had been registered under Sections 447 and 427 I.P.C. read with Section 149 I.P.C. on the file of Parkal Police Station on the same day. Pursuant to the investigation undertaken, the police found that the case was established against the accused and accordingly laid a charge sheet before the learned Judicial First Class Magistrate, Parkal, on 15.10.2015, which was taken on file vide C.C.No.309 of 2015. That apart, the learned Junior Civil Judge, Parkal, was stated to have passed order dated 04.01.2002 in E.P.No.

10 of 2000, directing the police authorities to assist the decree holder in executing the decree in O.S.No.30 of 1984. In the light of the afore-stated developments and as the police authorities have already been directed by the executing court to assist the decree holder for securing compliance with the decree in O.S.No.30 of 1984, no further adjudication is warranted on merits. The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
