This writ petition is filed to declare the action of the 1st respondent in issuing the Memorandum No.19/1/2008-Exam-II dated 06.12.2008 rejecting the age relaxation of 5 years, which is eligible for all Central Government Employees, as illegal and arbitrary. This Court while issuing Rule Nisi on 20.02.2009 granted interim direction to the respondents to consider the representation dated 15.12.2008 submitted by the petitioner and take appropriate decision and communicate the same to the petitioner. It is submitted by the learned counsel for the petitioner that in the similar circumstances this Court allowed W.P.No.17456 of 2007 through orders dated 04.03.2008 directing that the petitioner shall be extended the benefit of relaxation of age limit, in terms of Clause 3(III) (b)(iii) of Examination Notice No.10/2005 dated 07.05.

2005, and he shall be considered for selection, in accordance with law, and that the respondent shall conclude the remaining parts of the selection process, in respect of the petitioner, within a period of four weeks. The learned counsel submits that the petitioner herein is also similarly placed person.

The said fact has not been disputed by the learned counsel for the respondents.

In view of the same, this writ petition is allowed in terms of the orders of this Court in W.P.No.17456 of 2007, dated 04.03.2008. As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
