THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.4329 of 2015 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble court may be pleased to issue a Writ of Mandamus or any other appropriate Writ or direction declaring the order dated 31-1-2015 passed by the 3rd respondent rejecting the application of the petitioner for LPG distributorship at Anantapur as illegal and arbitrary and consequently direct the respondents to treat the petitioner as selected candidate for LPG distributorship at Anantapur and take further action as per the Guidelines For Selection of Regular LPG Distributors, and pass such other or further order or orders as deem fit and proper in the circumstances of the case."

I have heard the submissions of Sri P.Gangarami Reddy, learned counsel appearing for the petitioner, and of Sri O.Manohar Reddy, learned Standing Counsel for the Bharat Petroleum Corporation Limited appearing for the respondents 1 to 3. I have perused the material record.

The facts, which are discernible from the pleadings and submissions, are as follows: 'The petitioner has become eligible in the draw for selection of LPG Distributorship at Anantapur under open category. After the first two enlisted applicants have become ineligible on verification of their credentials, now the case of the present petitioner, which is eligible has come up for consideration. Further, the premises, which is taken for the subject establishment, is re-delivered to the owner of the premises and, therefore, the premises is not now available for establishment of the LPG

MSRM, J W.P.No.4329 of 2015 Distribution Unit/Agency. However, the fact of the matter is that the case of the petitioner is entitled for consideration is not in dispute.' 4.

In that view of the matter, the Writ Petition is disposed of directing the respondents to consider the claim of the petitioner as per the guidelines for selection for LPG Distributorship for March, 2015. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
