JUSTICE JUVVADI SRIDEVI FAMILY COURT APPEAL No.262 OF 2008 JUDGMENT: (Per Hon'ble Dr.SA,J) This appeal, under Section 19 of the Family Courts Act, 1984 (for short, 'the Act'), is filed by the appellant-husband aggrieved by the order, dated 03.09.2007, passed in F.C.O.P.No.249 of 2006 by the learned Judge, Family Court, Secunderabad, wherein, the subject F.C.O.P. filed by the respondent No.1-wife, under Section 10 of the Act, seeking declaration of divorce (Talaq) purported to have been pronounced by the appellant-husband on 06.05.2006, as null and void, was allowed.

Learned counsel for the appellant would submit that the respondent No.1-wife i.e., Shabnam Sultana had passed away some time back and therefore, the cause in the present appeal does not survive for adjudication.

Recording the said submission, the appeal is dismissed as infructuous.
