THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.5869 of 2016 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners question the order under revision passed by the Joint Collector, Karimnagar District, the 3rd respondent, as early as on 11.07.2012. The revision petition is of the year 2007. The affidavit of the petitioners however does not give single reason as to why the Writ Petition is moved after four years. It is well settled that the discretion under Article 226 of the Constitution of India cannot be exercised against stale claims.

In spite of asking the learned counsel for the petitioners to explain the reasons for the delay and laches by showing the averments in the affidavit, the contentions are raised only on merits without explaining the delay and laches. Hence, I am not inclined to entertain the Writ Petition and the same is liable to be dismissed. The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
