THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.246 OF 2024 O R D E R:

This Criminal Petition is filed under Section 438 of Code of Criminal Procedure (for short 'Cr.P.C.') by the petitioner/Accused No.2 seeking bail in the event of his arrest in connection with Crime No.03 of 2024 on the file of Sangareddy Rural Police Station, Sangareddy, registered for the offence under Sections 5 and 6 of Explosive Substances Act, 1908.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The Sangareddy Rural Police raided premises at Sri Laxmi Narsimha Stones & Rocks Pvt. Limited, Erdanur Village and found 44 boxes containing 8800 gelatin sticks, 100 loose gelatin sticks totaling to 8900 gelatin sticks and 1110 electrical detonators etc. 4.
On the basis of the said seizure, this petitioner was arrayed as A-2. The Police registered the case for the reason of storing explosive substances which endangers human life.

Learned senior counsel appearing for the petitioner would submit that petitioner is a license holder and due precautions were taken while procuring the said explosives.

Learned Additional Public Prosecutor did not dispute that this petitioner is a license holder.

In the said circumstances, the relief of anticipatory bail can be considered, subject to following conditions:-
1) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Sangareddy Rural Police Station, Sangareddy, on or before 19.01.2024. Upon such surrender, the said Station House Officer shall release the petitioner/Accused on bail, on him executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused No.2 shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter as and when required.
3) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
