HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.3652 OF 2013 ORDER:

This Civil Revision Petition is preferred against the order dated 10.07.2013 in I.A. No.217 of 2012 in O.S. No.443 of 2011 passed by the learned VIII Additional District and Sessions Judge (Fast Track Court), Gajuwaka.

2. Heard Sri N. Subba Rao, learned counsel for the revision petitioners, and Sri K. Sarva Bhouma Rao, learned counsel for the respondents, and perused the order under revision including the material on record.

3. Sri N. Subba Rao, learned counsel for the revision petitioners, would submit that no issue touching whether the Court fee paid is sufficient or not is settled for trial.

4. Both the counsel would agree that such an issue is required to be settled for trial in view of the controversy in the present revision petition.

5. Therefore, the trial Court is directed to frame an additional issue in relation to payment of Court fee as to whether the Court fee paid is correct?

6. With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs.
