HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.5855 of 2017 ORDER:

This writ petition is filed by petitioner challenging the action of respondents Nos.2 and 3 in not removing the illegal constructions and encroachments made in park i.e., land of an extent of Ac.1.20 gts., in Sy.No.134 and 136 situated at Gachibowli village, Serilingampally Mandal, R.R. District.

The case of the petitioner is as follows:

The land in Sy.Nos.134, 135 and 136 situated at Gachibowli, Serilingampally Mandal, is a Government Land and the then Government of A.P. constructed houses in the said land and sold the same to IV Class employees. Out of the total area, the land admeasuring Ac.1-20 guntas was earmarked for park area by the revenue department. While so, some land grabbers encroached upon the same and erected temporary huts. The members of the petitioner-association made a representation before the respondents. But no action has been taken so far. 3.

Heard and perused the material available on record. 4.

The main grievance of the petitioner is that in spite of the representation made by the members, the official respondents have not taken action against the illegal encroachments made in the subject land. 5.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The official respondents are directed to consider the representation of the members of the petitioner-association and take appropriate action against the illegal encroachments, if any made as alleged."
