J.Chinna Appala Naidu Vizianagaram Dist v. Prl Secy Rev Deept Hyd And 5 Others
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15612 OF 2016 ORDER:
This writ petition is filed stating that the petitioner is in possession and enjoyment of property in Sy.No.26-1 of Jagaram Village to an extent of Ac.02-76 cents and also total extent of Ac.10-24 cents covered in Sy.No.5-1 to 5-14, 6-8, 6-26, 6-7-213, 67-24 and 68-15 situated at Pavada Village. It is stated that the petitioner has made application for grant of pattadar passbooks and title deeds. But no orders are passed. Aggrieved by the same, the present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.
Learned Assistant Government Pleader for Revenue submits that no particulars are given and no documents are filed in support of the case of the petitioner except writ affidavit and he also submits that no application is made in Form Form-VI (A) of the A.P.Rights in Land and Pattadar Passbooks Act,1971. Perusal of the writ affidavit goes to show that except saying that petitioner's forefather purchased the said land, no particulars are given and no documents are filed in support of his case. The writ affidavit was drafted in casual manner without reference to the documents, on which the petitioner is relying and no application is filed in proper format. This shows callous attitude of petitioner in filing the writ petition.
Accordingly, the writ petition is dismissed. However, liberty is granted to the petitioner to institute fresh writ petition furnishing the details. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
