THE HON'BLE SRI JUSTICE T.AMARNATH GOUD M.A.C.M.A. No.1316 OF 2006 JUDGMENT:

This appeal is filed by the appellant-claimant aggrieved by the Order and Decree dated 19.10.2005 passed in O.P.No.153 of 2002 by the Chairman, Motor Accidents Claims Tribunal (V Additional District Judge), at Nizamabad (for short, the Tribunal).

For the sake of convenience, the parties are hereinafter referred to as they were arrayed before the Tribunal in the original petition.

Heard Sri K.Sarala Mahender Reddy, learned counsel for the appellant. Perused the material record.

At the time of hearing, learned counsel for the appellant stated that the subject matter in the present appeal has already been decided by this Court in MACMA.No.1293 of 2006 by judgment, dated 29.10.2019, pertaining to the accident occurred on 09.12.2001, wherein the claimant is one of the passengers along with others in the crime auto bearing No.AP 25T 9601. A copy of the order of this Court in the afore-stated appeal is placed on record.

In view of the submissions and the earlier orders of this Court and for the reasons alike as were mentioned in the earlier orders of this Court in the afore-stated appeal, this appeal is also allowed by awarding compensation of Rs.15,000/- towards

TA,J MACMA.No.1316 of 2006 grievous injury, payable by both the respondents jointly and severally. The compensation amount shall carry interest @ 7.5% per annum from the date of petition till the date of realization. The respondents are directed to deposit the compensation amount along with proportionate costs and interest within two

(02) months from the date of receipt of a copy of this order. On such deposit, the appellant is permitted to withdraw the entire amount. There shall be no order as to costs. As a sequel thereto, Miscellaneous Applications, if any, pending in this appeal shall stand closed.
