THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.121 OF 2019 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A.2 and A.3, for grant of bail in Crime No.322 of 2018 of Adibatla Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 306 read with 34 of IPC.

Heard the learned counsel for the petitioners/A.2 and A.3, the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

Learned counsel for the petitioners/A.2 and A.3 would contend that the petitioners are innocent persons. They have nothing to do with the death of the three deceased persons in this case. There are no specific allegations in the suicide notes purported to have been written by the deceased. The petitioners/A.2 and A.3 are falsely implicated in this case and ultimately, prayed to allow the petition. 4.

Learned Additional Public Prosecutor representing the respondent/State opposed the grant of bail to the petitioners/A.2 and A.3 and ultimately, prayed to dismiss the petition. 5.

As per the material placed on record, S.Hanumanth, S.Chandrakala and S.Manjula committed suicide by hanging in their house on 23.11.2018 during night hours. There are two suicide notes. In the course of investigation also, it has come up that the petitioners/A.2 and A.3 along with other accused in this case have made baseless allegations against the deceased persons. Due to the harassment meted out by them, the deceased persons, who are

husband, wife and daughter committed suicide. The allegations against the petitioners/A.2 and A.3 are specific and grave. The investigation is in progress. Release of the petitioners/A.2 and A.3 under Section 439 Cr.P.C. at this stage would hinder the investigation. Under these circumstances, it is not a fit case to allow the petition.
