ORDER:

This writ petition is filed for a mandamus to declare the action of the respondents in seizing 120 quintals of BPT rice belonging to the petitioner and initiating proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act'), with respect to the seized stock as illegal and arbitrary.

The petitioner sought for the consequential direction to the respondents to release the seized stock. At the hearing, Mr.W.B.Srinivas, learned counsel for the petitioner, submitted that since the proceedings under Section 6-A of the Act have been finalized, the cause in the writ petition has become infructuous.

The Writ Petition is accordingly dismissed as infructuous. As a sequel to dismissal of the writ petition, interim orders, dated 06.08.2009 in W.P.No.16070 of 2009, and dated 10.08.2009 in W.P.M.P.No.21087 of 2009, are vacated and W.P.M.P.No.21087 of 2009 filed by the petitioner for interim relief shall stand dismissed as infructuous.
