THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37323 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in registering the FIR No.372 of 2016 and calling the petitioners to the police station and making threats to withdraw the civil suit, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioners is that the 4th respondent has filed a private complaint with false story on 20.06.2016 and the same was referred to the 3rd respondent, who registered the same as FIR No.372 of 2016, dated 14.07.

2016, for the offences punishable under Sections 409, 420, 425, 464, 468, 323, 506-II IPC and the main grievance of the petitioners is that the respondent police are calling the petitioners to the police station and making threats to withdraw the civil suit and are harassing and interfering with the personal liberty of the petitioners. Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.372 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
