HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17084 of 2016 ORDER:

This writ petition is filed seeking the following prayer: "..to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.3 in entertaining the appeal and passing orders vide proceedings D.Dis./C3/327/2015, dated 22-08-2015 is illegal, arbitrary and violation of principles of natural justice, consequently set aside the same, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." Both the learned counsels state that revision against the impugned order is pending before the 2nd respondent-Joint Collector, Anantapuram. In view of the above, without going into the merits of the case, this Court deems it appropriate to direct the 2nd respondent to dispose of the revision in accordance with law, within eight (8) weeks from the date of receipt of a copy of this order. While disposing of the same, the 2nd respondent shall also consider the issue regarding limitation in filing appeal before 3rd respondent by 5th respondent.

The interim suspension granted by this Court on 03.06.2016 shall be continued till disposal of such revision.

With the above directions and observations, this Writ Petition is disposed of. No costs.
