HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.3093 of 2016 ORDER:

The Writ Petition is filed challenging the auction notice dated 28.01.2016, where under respondent No.2 proposed to lease out sand mining in an extent of 14 acres in PB Anakatta (Paleru - Bitraguntta Anakatta), Prakasam District to a quantity of 57,000 qubic meters without considering the representation of the petitioners.

When the vacate petition is taken up for hearing, learned Government Pleader for Industries and Commerce stated that, subsequently there is change in policy by the Government and the Government dispensed with conducting of auctions for excavation of sand. He has circulated copy of notification issued vide G.O.Ms.No.42, Industries and Commerce (Mines-II) Department, dated 29.03.2016, where under the relevant provisions of Andhra Pradesh Minor Mineral Concession Rules, 1966 were amended.

The counsel for petitioners and learned Government Pleader for Industries and Commerce fairly submit that, in view of the subsequent change in the policy of the Government, the cause in the writ petition does not survive. Accordingly, the Writ Petition is dismissed. Interim stay granted on 03.02.2016 stands vacated. Miscellaneous

petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
