Y.Shivaji, v. Sri K.K. Misra,
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR CC Nos. 1649 and 1650 of 2013 Date of Judgment: 9.2.2015 Between:
Sreeram Ramamurthy and Y. Shivaji
...Petitioners
And Sri K.K. Misra, Chairman & Managing Director, Andhra Bank, Pattabhi Bhavan, Saifabad, Hyderabad and others ..Respondents THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR CC Nos. 1649 and 1650 of 2013 COMMON ORDER:
Heard learned counsel for the parties.
These contempt cases are filed alleging noncompliance of orders of this Court in W.P.Nos.9069 of 2011 and 1033 of 2011, dated 22.3.2012 and 26.3.2012 respectively, even though they were confirmed by a Division Bench of this Court in W.A.No. 902 of 2012 and
W.A.No. 905 of 2012, dated 8.8.2013 and also by the Supreme Court in SLP (C) Nos. 35389 and 35449 of 2013.
On earlier date of hearing, it was informed by Dr. Lakshmi Narasimha, learned standing counsel for the respondents that the respondents-bank has taken a decision to pay pensions to both the petitioners in compliance of the orders of this Court. He has also placed copies of decision of Board of Directors under letter dated 8.12.2014 and also letters addressed by Chief Manager of the respondent-bank to each of the petitioners dated 27.1.2015 informing them that the competent authority has approved the sanction of pension to each of the petitioners and advised them to submit pension papers along with photographs of spouse. It is also represented by the learned standing counsel that the petitioners have also approached the Chief Manager of the respondentbank and submitted the required papers. Since the orders of this Court are complied with, I do not see any reason to pursue the contempt cases which are accordingly dismissed. However, the petitioners are at liberty to revive the contempt in the event of any further disobedience of orders of this Court in complying with the same.
Miscellaneous applications, if any shall stand
closed. No order as to costs.
