HON'BLE JUSTICE G. SRI DEVI I.A.No.1 of 2020 IN/AND CRIMINAL PETITION No.199 of 2020 ORDER :

This Criminal Petition is filed by the petitioners to modify the order, dated 27.12.2019 passed in Crl.M.P.No.1234 of 2019 in Cr.No.326 of 2019 by the I Addl. Sessions Judge, Karimnagar.

The learned Sessions Judge vide impugned order, while granting anticipatory bail to the petitioners, directed them to surrender before the SHO P.S.

Sulthanabad within a period of 15 days from that day and on such surrender, they shall be enlarged on bail on their executing personal bond for Rs.25,000/- with two sureties for a like sum each to the satisfaction of the said S.H.O. and also imposed other conditions.

Learned counsel for the petitioners submits that the Court below ought not to have imposed condition to execute personal bond of Rs.25,000/- with two sureties. In order to obtain anticipatory bail, the petitioners have to deposit Rs.12,75,000/- in shape of sureties and bonds. He further submits that the majority of the petitioners are of the same family and they do not have means to deposit such a huge amount and hence, he prays to reduce the surety amount.

Taking into consideration the nature of offences alleged and having regard to the facts and circumstances of the case, I deem it appropriate to modify the said order. 5.

Accordingly, the Criminal Petition is disposed of and the order, dated 27.12.2019 passed in Crl.M.P.No.1234 of 2019 in Cr.No.326 of 2019 by the I Addl. Sessions Judge, Karimnagar, is modified by directing the petitioners to surrender before the S.H.O. P.S. Sulthanabad on or before 20.01.2020 positively and on such surrender, the petitioners shall be enlarged on bail on each of them executing a personal bond for a sum of Rs.5,000/- with two sureties for a like sum each to the satisfaction of the said S.H.O. P.S. Sulthanabad. However, the other conditions imposed by the learned Sessions Judge in the impugned order shall remain intact. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE G.SRI DEVI DATED: 08.01.2020.
