Heard learned counsel for the petitioner and learned counsel for the respondents.
Essentially, the dispute is in relation to the rights of the parties with respect to vast extent of land. While the petitioner has right over the land in question, the respondents claim that the land is 'defence land'. As there are disputed questions of fact which require investigation and for establishing the same, a full-fledged trial is necessary, no orders as such can be passed as the writ petition is not a proper remedy.
In those circumstances, the writ petition is closed by giving liberty to the petitioner to approach the civil Court seeking appropriate relief.
