HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6873 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in not filling up the vacancies as per notification dated 27.03.1999, as illegal and arbitrary. A consequential direction is also sought to the respondent to appoint the petitioner to the post of Principal basing on her merit. Heard both sides.

It has been contended by the petitioner that the respondent society issued a notification for filling up certain vacancies, but however, they have not filled up the vacancies and she is eligible for appointment as she possessed the requisite qualification. This Court having considered the said submission is of the considered view that if the petitioner has any grievance against nonfilling up of the posts in pursuance of the notification dated 27.03.1999, she is at liberty to submit a representation to the respondent within one week and upon receiving such representation, the respondent shall consider and pass appropriate orders within four weeks thereafter.

With the above observation, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 30th October, 2018 cbs
