THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.16683 of 2007 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief :- " .... to issue a writ or order of direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents (i) in not reducing the maximum demand charges for the non-supply period and (ii) in not calculating the load factor based on the actual hours of supply for the purpose of tariff incentive for which the petitioner is entitled as per the tariff order 2006-07 for the consumption months of January to April, 2007 as highly illegal, arbitrary, unjust and void consequently set aside letter No.CGM(Comml)/ SE(C)/ DE(C)/ ADE-II/ F.No. Jeevaka/ D.No.315/ 2007 dated 28.05.2007 of the 2nd respondent ....."
At the hearing, learned counsel for the petitioner fairly stated that the issue involved in this writ petition is covered by a common order dated 04-03-2014 in W.P.No.7865 of 2009 and batch and that following the said common order, the writ petition may be disposed of in terms of the said common order.
Copy of the said common order passed in W.P.No.7865 of 2009 and batch is placed on record.
Learned Standing Counsel appearing for TSTRANSCO does not dispute the fact that this matter is covered by the afore-said common order of this Court in the said writ petition batch. In that view of the matter, the writ petition is dismissed in terms of the common order dated 04-03-2014 in W.P.No.7865 of 2009 and batch and for reasons alike as were mentioned therein. No costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
