HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.47 OF 2018 O R D E R :

This contempt case is filed alleging violation of order dated 27-06-2016 passed by this Court in WPMP.No.25019 of 2016 in WP.No.20399 of 2016, wherein this Court suspended the proceedings dated 19-10-2015 cancelling the pattadar passbook and title deed of the petitioner.

Learned counsel for the petitioner basing on the counter affidavit submits that though final order is implemented by Tahsildar and the petitioner's name was restored in the webland, again the present respondent mentioned that the properties claimed by the petitioner through pattadar passbook and title deed are disputed properties and he has made entry as dispute property. As such, there is violation of orders passed by this Court.

On the other hand, learned Assistant Government Pleader for Revenue filed counter affidavit and in para No.4 of counter it is stated that the respondent has not entered the serial numbers of the petitioner as they are not pending at Tahsildar Revenue Court. The petitioner has never visited the Tahsildar office and not brought the issue to the notice of Tahsildar office and notice of this respondent. One Sri Anumolu Prasad came to the office of Tahsildar, Ponnalur and requested to remove the serial numbers from the Dispute Register. Then this respondent stated that he is not

responsible to enter the serial numbers in the dispute Register with technical evidence and he has also shown the serial numbers are not pending at Tahsildar login. The petitioner having known the above facts with an intention to harass this respondent filed the present contempt case. This respondent took steps to remove the above serial numbers above serial numbers on 20-01-2018 and informed the same to the petitioner on the same day. The said averments in para No.4 of counter affidavit are not disputed by learned counsel for the petitioner and no reply affidavit is filed disputing the same.

Since the order is complied with as per counter affidavit, I do not see any violation of orders passed by this Court. Accordingly, the contempt case is closed. As a sequel thereto, miscellaneous applications, if any, pending in this case, shall stand closed.
