THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.24833 of 2009 ORDER:

The action of the respondents, in not considering the petitioners' case for allotment of divisions for execution of sanitation works to each of them on nomination basis, in terms of the proceedings dated 14.07.2009 issued by the Commissioner and Director of Municipal Administration, Hyderabad, is questioned in this Writ Petition as being arbitrary and illegal. By proceedings dated 14.07.2009, the Commissioner and Director of Municipal Administration permitted the Commissioner, Warangal Municipal Corporation to consider the request of the applicants for allotment of privatized sanitary units on main roads for a period of two more years on nomination basis. Seeking parity, the petitioners invoked the jurisdiction of this Court. By order in W.P.M.P.No.32336 of 2009 dated 17.11.2009, this Court held that, if the works which were allotted to the petitioners earlier were not notified, the respondents shall consider their request as per the impugned proceedings dated 14.07.2009.

As noted hereinabove, the proceedings dated 14.07.2009 permitted the works to be given on nomination basis for a period of two years. The said period expired in 2011, more than six years ago. It is evident, therefore, that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court, and the Writ Petition has become infructuous. The Writ Petition is, accordingly, dismissed as infructuous.

Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
