HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24514 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus to direct the respondents 1 to 5 to pay compensation for the illegal demolition of the petitioner's building in R.S.No.913/3 of Chinthalapudi village and Grampanchayat, West Godavari District as per the proceedings issued by the 2nd respondent herein in Roc.E-Computer No.G1/7211/2015, dated 18-02-2016 and consequently direct the respondents to pay all benefits to the petitioner as per law. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development and the learned Government Pleader for Revenue. The contention of the learned counsel for the petitioner is that the respondents herein demolished the house of the petitioner in R.S.No.

913/3 of Chinthalapudi village and Grampanchayat, West Godavari District for the purpose of road widening. A perusal of the record reveals that on 18.02.2016 the District Collector, West Godavari District, directed the Revenue Divisional Officer to take necessary action for payment of compensation to the petitioner as per the orders of this Court.

"In the reference 9th cited, the petitioner Sri Patnala Mallikarjuna Rao has put in a representation before the District Collector, West Godavari, Eluru, stating that the Assistant Government Pleader Sri N.Yesu Ratnam has informed him that the District

Collector, Joint Collector, Revenue Divisional Officer and District Panchayat Officer agreed to pay the amount to the land and also to pay the loan amount of Rs.7,00,000/- and other benefits within 2 to 3 months as per the norms of the Government and finally requested to pay the Building Compensation by 20.02.2016 as the Bank Officials are pressing for payment of loan."

A perusal of the above clearly demonstrates that the official respondents in principle agreed to pay the compensation to the petitioner for demolition of his house. The only apprehension of the petitioner is that the respondents may take some more time for payment of compensation.

Having regard to the facts and circumstances of the case, the respondents 2 to 6 are hereby directed to pay the compensation amount to the petitioner as agreed by them as early as possible, preferably, within a period of two months from the date of receipt of copy of this order.

Accordingly, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
