THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.6655 OF 2013 ORDER:

Heard the learned counsel for the petitioner and the learned Additional Standing Counsel appearing for the respondents 1, 2 & 5. The prayer sought for in the writ petition is as under: " to issue an appropriate writ order or direction more particularly one in the nature of writ of mandamus directing the respondents to pay the freedom fighters pension to the petitioner by setting aside the impugned order No.112/ 38/ 94-FF(HC)D, dt.19.02.2013 of the 1st respondent, by holding that the impugned order passed by the 1st respondent is illegal, arbitrary, without jurisdiction, non application of mind and violation of Arts.14 and 21 of the Constitution of India."

During the course of arguments, it is brought to the notice of this Court from the counter affidavit filed on behalf of respondents1,2 and 5 that the impugned show-cause notice issued does not find in the records of the Ministry and the same is not authentic and has been forged by some mischievous person. In the light of the above said specific statement made in the counter affidavit, this Court is of the opinion that there is no cause for filing the writ petition.

Accordingly, the writ petition is closed. No costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.KESHAVA RAO,J 19th NOVEMBER 2018.
