THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.7287 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. challenging the order dated 18-03-2016 in Crl.M.P.No.514 of 2016 in C.C.No.358 of 2012 passed by the I Additional Junior Civil Judge, Sattenapalli, Guntur District, allowing the petition filed under Section 205 Cr.P.C. seeking to dispense with the presence of the petitioner/A-1.
Heard the learned counsel for the petitioner and perused the material on record.
Having heard the learned counsel for the petitioner and on perusal of the material on record including the order under challenge, this Court is of the view that the conclusions arrived at by the learned Magistrate in passing the order do not suffer from any serious infirmity or illegality warranting interference of this Court under Section 482 Cr.P.C, since the same were made in the facts and circumstances of that case and hence, this Court is not inclined to interfere with the proceedings.
However, having regard to the facts and circumstances of the case and in view of the fact that the case is pending since 2012 onwards, the trial Court is directed to dispose of the case as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of the order. Accordingly, the criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending,
shall stand closed.
