HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 753 of 2018 Order:

The petitioner was appointed as Anganwadi Helper at Chakalibanda Anganwadi Centre based on her 7th Class qualification. She has completed 30 years of service. While so, without issuing any charge memo, a show cause notice was issued on 10.07.2017 and the petitioner submitted her explanation on 02.08.2017. When an order of termination of services of the petitioner was passed on 23.10.2017 without conducting any enquiry the petitioner preferred an appeal to the second respondent on 11.11.2017 and the same is pending. When the appeal was not disposed of, she filed the present Writ Petition. Learned counsel for the petitioner submits that the termination order was passed without conducting any enquiry and without giving any opportunity to the petitioner to submit her case. Learned Government Pleader, on the other hand, submits that there is no provision for appeal.

Be that as it may, since an appeal was filed by the petitioner on 11.11.2017 and the same is pending before the second respondent, this Writ Petition is disposed of directing the second respondent to consider the appeal dated 11.11.2017 and pass appropriate orders in accordance with law within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
