This Criminal Petition is filed under Section 482 Cr.P.C. to call for the records relating to C.C.No.157 of 2011 on the file of I Additional Judicial Magistrate of First class, Tenali, registered for the offences punishable under Sections 406 and 420 IPC, against the petitioner/A.1 and others.

Heard learned counsel for the petitioner.

Learned Public Prosecutor submits that in this case charge sheet is already filed, therefore, the petitioner/A.1 may be directed to seek appropriate relief in the lower Court by filing discharge petition.

A perusal of the complaint, prima facie shows some allegations against the petitioner.

Hence, considering the above facts, the Criminal Petition is dismissed. However, the petitioner/A.1 is at liberty to file a discharge petition before the Court below. Considering the request of petitioner, the Court below is directed not to insist upon the presence of the petitioner before the Court below, unless it is necessary for the proceedings of the case.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
