Heard learned counsel for the petitioner and the Government Pleader for respondents.

The petitioner states that he is the absolute owner and possessor of landed property admeasuring Ac.1.00 cents each in Sy.Nos.49/ B and 49/ C of Namburu Village of Pedakakani Mandal of Guntur District. The property situated in Sy.No.49/ B was acquired by him under a registered Gift Settlement Deed dt. 07.12.1984 and he was issued pattadar passbooks and title deeds for the said lands. He decided to gift the said property to his daughter. When he approached respondent No.9 for the said purpose, it was stated that the said property was endowment land and the Commissioner of Endowments, Hyderabad, addressed a Letter on 24.12.2008 prohibiting registration of certain properties including the above said property on the ground that it belongs to Sri Seetharamanama Sankeerthana Sangham, Sampathnagar, Guntur. In view of the same, the petitioner submitted a representation on 10.04.2017 to the respondent Nos. 2, 5 to 8 and sought for issuance of No Objection Certificate.

Though the petitioner submits that respondent No.9 has no jurisdiction to ask for submission of 'No Objection Certificate', in view of the inclusion of the said property in the list of prohibited property, the competent authority to take a decision in this regard is respondent No.2 as

per the full bench judgment of this Court in Vin j am u r i Raj agopal Ch ar y v. St at e of A.P1.

It is stated by the learned counsel for the petitioner that he has not submitted any representation to respondent No.2 in terms of the full bench judgment as aforesaid. In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to submit a representation to respondent No.2 and as and when such representation is submitted by the petitioner, the same shall be considered by respondent No.2, in accordance with law, within a period of two months from the date of receipt of such representation.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
