BALAYOGI F.C.A.No. 285 of 2017 JUDGMENT:- (ORAL) Per Hon'ble Sri Justice Suresh Kumar Kait) Admittedly, an application under Order 9 Rule XIII C.P.C. is pending adjudication before the trial Court. When an application under Order 9 Rule XIII C.P.C. is pending, the present appeal is not maintainable. Hence, the appeal is dismissed. However liberty is granted to the appellant to approach the appropriate forum after disposal of the application which is pending before the Judge, Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad. It is made clear that this order shall not in any manner affect the application pending before the trial Court. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
