HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.Nos.10914 and 10915 of 2016 COMMON ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for respondent Nos.1 to 4.

Petitioners' grievance is that an appeal has been entertained at the instance of respondent Nos.5 and 6 by 3rd respondent under the provisions of the AP Record of Rights in Land and Pattedar Passbooks Act, 1971 eighteen years after the names of the petitioners have been mutated in the revenue records and pattedar passbooks and title deeds have been given to them.

Learned counsel for the petitioners contends that objections have been filed by the petitioners before 3rd respondent raising a plea that the appeal filed by the private respondent is barred by limitation and that 3rd respondent is proceeding to decide the matter ignoring the objections raised by the petitioners.

Learned Government Pleader for Revenue appearing for respondent Nos.1 to 4 states that 3rd respondent will consider the objections filed by the petitioners regarding the plea of limitation and on merits

and then decide the matter in accordance with law.

In view of the said submission, both the Writ Petitions are disposed of directing 3rd respondent to consider the objections filed by the petitioners in these Writ Petitions to the appeal filed by respondent Nos.5 and 6 herein within four weeks from the date of receipt of a copy of this order and communicate his decision thereon to the petitioners. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
