THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.3114 of 2013 ORDER:

The petitioner prays for police protection for undertaking construction survey of subject plot etc., particularly having regard to the decree of perpectual injunction granted in O.S.No.538 of 2002 by the Principal Junior Civil Judge (East and North), L.B.Nagar, Ranga Reddy District.

I have perused the record and this Court is of the view that a few disputes are still presented in enjoying the property by the petitioner. The disputes, if are at the instance of a party to the decree in O.S.No.538 of 2002, the petitioner can file an execution petition or complain violation of injunction order before the trial Court. This Court finds it difficult where identity is also disputed to direct consideration of representation of petitioner and provide police protection without deciding the basic facts, such a direction would lead to authorising police to interfere in civil disputes. By leaving it open to the petitioner to work out the remedies in accordance with law before the trial Court, the Writ Petition is dismissed. No order as to costs.

Miscellaneous petitions, if any, pending in this case shall stand disposed of.
