THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SMT. JUSTI CE ANI S WRI T PETI TI ON No.8628 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The Union of India and its postal authorities filed this writ petition aggrieved by the order dated 22.10.2014 passed by the Central Administrative Tribunal, Hyderabad Bench, Hyderabad, in O.A.No.365 of 2012. The said O.A. was filed by the first respondent herein seeking financial upgradation (MACP-II) with effect from 01.09.2008 with grade pay of Rs.4,200/- on completion of 20 years of regular service and to grant him MACP-III on completion of 30 years of service with grade pay of Rs.4,600/- with effect from 30.03.2009.
By the order under challenge, the Tribunal took note of the fact that the Jodhpur Bench of the Central Administrative Tribunal had granted relief to persons similarly situated in O.A.Nos.353, 354 and 382 of 2011 and followed the said decision. The O.A. was accordingly allowed but the Tribunal observed that it would be subject to the final outcome of W.P.No.11336 of 2012 and batch pending before the High Court of Rajasthan in relation to the decision of the Jodhpur Bench of the Central Administrative Tribunal. It is now stated by Sri Ch.Ravinder, learned counsel appearing for the first respondent, that the Rajasthan High Court dismissed W.P.No.11336 of 2012 and batch vide order dated 10.08.2015. A copy of the said order is also placed on record.
In the light of this development, we find no reason to interfere with the order passed by the Tribunal following the decision of the Jodhpur Bench of the Central Administrative Tribunal which, in effect, stands confirmed by the dismissal of the writ petitions by the Rajasthan High Court.
The writ petition is devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
