THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL APPEAL No.296 OF 2016 ORDER:

This Criminal Appeal is filed by the appellant - complainant, challenging Judgment, dated 17.12.2015, passed in C.C. No.356 of 2010 by the Judicial Magistrate of First Class, Anaparthy, whereby the learned Magistrate acquitted the 2nd respondent - accused for the offences punishable under Sections 403,408, 418 and 477-A IPC. A perusal of the record discloses that the appellant has directly approached this Court without challenging the judgment of the Court below before the appellate Court. Hence, this Court is of the view that this appeal can be disposed of directing the appellant to approach the District & Sessions Court concerned and file the appeal. Accordingly, this Criminal Appeal is disposed of directing the appellant to approach the appellate Court i.e. the District & Sessions Court concerned and file an appeal. If there is any delay in preferring the appeal before the District & Sessions Court concerned, the Court concerned is directed to condone the same, since the appellant approached this Court.

Miscellaneous petitions, pending if any, shall stand closed. Registry is directed to return the original papers to the appellant under proper acknowledgment.
