HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37038 OF 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the 1st respondent in not registering Diploma Certificate in Public Health and Sanitation Technology, issued by the Public Health & Hygiene, New Delhi of the petitioner for appointment to the post of MPHA (Male) inspite of the Government Memo, dated 31.05.2008, as arbitrary and illegal and consequently declare that the petitioner is eligible to register his name in the A.P. Para Medical Board as per the his certificates. Heard and perused the material available on record. The petitioner completed one year Diploma Course in Public Health and Sanitation Technology issued by the Public Health & Hygiene, New Delhi, in the year 2002. The District Collector, Nellore, issued notification, dated 14.03.

2015, for filing up of the backlog vacancies for disabled persons, for the post of Multipurpose Health Assistant (Male) in PH (HH) quota, and since he is eligible for the same, he applied for the said post and he was provisionally selected. Since he has not registered his Diploma certificate with the A.P. Para Medical Board - 1st respondent, he made an application for registration of his Diploma Certificate by duly paying requisite fee through challan, on 15.03.2016. The 1st respondent also informed the petitioner that his application will be considered in due course, vide letter, dated 21.03.2016. The grievance of the petitioner is that though a communication was received by him on 21.03.

date the petitioner has not received any communication from the 1st respondent. Hence, he prayed this Court to direct the 1st respondent to take decision on his representation, dated 15.03.2016, and to pass appropriate orders within a time frame.

Considering the facts and circumstances of the case and taking into consideration the grievance of the petitioner, this Court is inclined to pass the following order:

The 1st respondent is directed to consider the application, dated 15.03.2016, submitted by the petitioner and communicate the decision taken on the said application, within a period of one month from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, pending if any, shall stand closed.
